An industry dynamic construction group facing serious costs overruns and numerous disputes with various Head Contractors across different projects, engaged Ioannoù Coétus to undertake an Audit of its Project Governance model.
Working in collaboration with design, engineering and construction staff, Ioannoù Coétus undertook a top-down review and bottom-up analysis of project data. In developing our Audit Report, Ioannoù Coétus addressed various pressing longer-term strategies as we offered an unprecedented look at the entire value chain.

Focusing on delivering best-practice project governance including, the development of policies, guidelines and procedures, monitoring and tracking of project activities, the management of project risk and the provision of advice on project control and conflict of interest matters, we provided support to Senior staff and project teams.

A contractor's construction project endured various timeline changes from its initial plan due to wide range of factors, including significant factors outside its control. Leaving the contractor unprotected and in a dangerous financial situation because they were directed to perform significant tasks that were not a part of the original scope, impacting adversely upon the progress of the works, and further failed formally to submit the required notice(s) pursuant to the contract.
​
The various variations and critical delays that occurred to the progress of the works and the alleged failure to give notices was said to prevent the contractor to be entitled to an extension of time to the date for completion of the works caused by various events, for which the Head Contractor was considered to be liable under the terms of the contract.
​
The notice provision was a condition precedent and failure to give the relevant notices within the time and in the form prescribed stipulated in the contract, was said by the Head Contractor, that it resulted in the contractor losing its entitlement to additional time and liquidated damages were applied, amongst other backcharges.
​
Ioannoù Coétus was engaged to provide our client with effective and accurate contractual and claims advice, based on detailed and thorough forensic examination and analysis of project information and data in respect of various claims. We prepared and wrote a detailed formal quantum and commercial claims report, putting forward reasoned, logical arguments supporting claims events. Ioannoù Coétus further assisted with the preparation of adjudications, forensic delay report and presentation and negotiation of claims.

Even through an organisation had policies and practices to define project scope and monitor program, it fall into trouble when scope change and scope creep occurred on the project. The change in scope was unavoidable and the scope creep was not appropriately captured.

There was a need to monitor scope change and control it, which may have avoided the disputes.
​
Ioannoù Coétus was engaged to assess variation entitlements and investigate the nature and extent of various backcharges and sett-offs appearing into a Payment Schedule, from the Head Contractor. Identifying the added scope and loss of productivity underpinned our provisional engagement, prior to been requested to consider rebutting delay claims from the Head Contractor and supporting with an Adjudication to successfully resolve the various disputes.

Ioannou Coetus was recently engaged by a contractor to undertake retrospectively a Disruption Analysis, on a Government project, to identify, distinguish and demonstrate the loss of productivity and hence additional losses and expenses over and above that which would have been incurred as a result of the Covid-19 construction site restrictions.

Ioannoù Coétus further assisted in identifying the contractual route to recovery deriving the entitlement, giving the contractor the right to claim for loss and expense arising from the cause.
