Consideration is required as to the effect and operation of a number of important provisions regularly included in construction contracts. Time-bar provisions, conditions precedent or limitation or exclusion clauses are common in such contracts. Detailed notices must be submitted within a strict timeframe and are required to be fully documented. Failure to do so would likely result in a contractor being time barred from bringing what would otherwise have been valid claims under the contract for delays to completion and could expose them to liquidated damages or possibly general damages claims for breach of contract.
Another example of a common risk of contractor claim is when delay and/or disruption actually occurs. Issues of (a) clearly articulating the cause(s) for the delay together with any measures proposed to overcome or mitigate the delay (whether or not the delay is excusable delay and has caused or will cause activities on the critical path to be delayed) within any stipulated time frame and satisfying any conditions precedent, (b) quantifying the period of delay; (c) the effects of disruption; and (d) the quantification of the resulting loss can be very complicated.

Disruption claims are endemic in the construction industry and result in time and cost overruns. These claims are very difficulty to quantify, as they can occur during working days and can lead to productivity losses which, in turn, can lead to time and cost overruns.
